Receh.in - President Joko Widodo has issued the Government Regulation in Lieu of Law (Perppu) No. 2/2022 on Employment Creation dated December 30, 2022. This regulation fills the legal gap following the Constitutional Court's decision in November 2021 to declare Law No. 11/2020 on Employment Creation as conditionally unconstitutional.
At that time, the Constitutional Court ordered the government and the Parliament to revise the Employment Creation Law within a 2-year period.
The Coordinating Minister for Economic Affairs, Airlangga Hartarto, stated in a press conference with the Coordinating Minister for Political, Legal, and Security Affairs, Mahfud MD, and the Deputy Minister of Law and Human Rights, Edward Omar Sharif Hiariej, at the Presidential Office on Friday (30/12/2022) that the issuance of the Perppu is urgent due to the threat of global recession and the high level of uncertainty facing Indonesia's economy.
"The President has spoken with the Speaker of the Parliament and the Speaker has been informed in principle about the Perppu on Employment Creation," he said. With the issuance of the Perppu, which laws are affected?
Based on a copy of the Perppu received by media, at least 75 laws are affected by this omnibus law, including the deletion of certain provisions, the addition of new provisions, or changes to the content of the regulations.
These laws cover a range of areas including labor, BPJS (Social Security Administration), Islamic banking, and investment regulations. Here is a list of the 75 laws affected by the Perppu on Employment Creation:
